1. General Provisions
These Terms of Service (“Terms”) govern purchases made through the KAKAS KICKS online store. By placing an order, the customer agrees to these Terms.
2. Products
All products offered (sneakers, accessories) are original and new.
Product photos are for illustration purposes. Colors and details may slightly differ depending on the device or display settings.
Availability of products is not guaranteed. If a product is out of stock after an order has been placed, the customer will be notified and a refund will be issued.
3. Prices and Payment
Prices are listed in euros (EUR) and include applicable taxes, unless otherwise stated.
Accepted payment methods: cash on delivery (COD), card payments, online payment systems.
The total price, including shipping costs, is shown before the customer finalizes the order.
4. Ordering Process
The customer must provide accurate and truthful information (name, address, email, phone number).
The seller reserves the right to reject or cancel an order if:
fraud is suspected,
incorrect pricing was displayed,
the product is unavailable.
5. Shipping and Delivery
Orders are shipped via courier services (e.g., Packeta, DPD).
Shipping costs and estimated delivery times are displayed before finalizing the order.
The seller is not liable for delivery delays caused by the courier, customs, or other circumstances beyond the seller’s control.
6. Right of Withdrawal (14 Days)
Under EU law, consumers have the right to withdraw from the purchase within 14 days of receiving the goods, without providing a reason.
Returned items must be in original condition, unused, and with tags attached.
Return shipping costs are borne by the customer, unless the product was delivered faulty or incorrect.
Refunds will be processed within 14 days after receiving the returned goods, using the same payment method as the original transaction.
7. Warranty and Liability for Defects
Customers are entitled to a 2-year statutory warranty under applicable EU law.
The warranty does not cover normal wear and tear, or damage caused by misuse or improper care.
To submit a claim, customers must contact info@kakaskicks.com, including their order number and photo evidence of the defect.
8. Limitation of Liability
The seller is not liable for indirect damages, including loss of profit or delays caused by third parties.
Liability is limited to the amount paid by the customer for the purchased goods.
9. Data Protection
The processing of personal data is governed by our Privacy Policy.
By placing an order, the customer consents to their personal data being processed for order fulfillment and shared with courier services for delivery purposes.
10. Governing Law
These Terms are governed by the laws of the Slovak Republic and applicable EU consumer protection laws.
Any disputes shall be resolved before the competent courts of Slovakia.
